TOS for KODX.DEV
1. Service Nature & Scope
This agreement is for a professional one-time configuration and optimization service, not a digital software product or ongoing subscription. Our service employs various techniques, which may include the installation and configuration of third-party plugins (including free versions), server-level adjustments, and custom code to achieve the performance and security goals outlined in your purchased package.
All services listed apply to only single WordPress site installations and do not include WordPress Multisite.
- Speed Optimization: Performance improvements including caching, image optimization, and core speed enhancements plus image delivery network integration.
- Security Hardening: Core file integrity, firewall, file permissions and directory locks, tampering prevention among many other. See full product page for details.
- All-in-One: Speed Optimization + Security Hardening: All previous features plus security hardening, file and directory permission fixes, login protection, and firewall configuration.
2. Third-Party Tools & Premium Subscriptions
As part of our service, we may install and configure free versions of third-party plugins to achieve your site’s goals. The ongoing functionality and updates of these free plugins are managed by their respective developers, not KODX.dev.
Many of these tools offer premium versions that provide enhanced features, such as faster signature updates, real-time firewall rules, or priority support. KODX.dev does not include or manage these premium subscriptions as part of this one-time service. If you desire ongoing premium protection or features, you may subscribe directly with the plugin developer. We may, at your request, offer a separate ongoing maintenance plan to manage these premium services on your behalf.
3. Customer Responsibilities
The Client agrees to:
- Provide accurate website information and temporary administrative access for the agreed-upon service period.
- Maintain a complete and restorable backup of the site before service begins.
- Ensure their hosting environment meets the technical requirements for the services requested (e.g., a server must have Redis installed if Redis object caching is to be configured). The client is solely responsible for their hosting environment’s compatibility and performance. Service delays or limitations caused by inadequate hosting will not result in refunds.
4. Security Services
Security features are applied only in the Total Security Hardening package and All-in-One package. The provider is not responsible for server-level security, future plugin or theme updates, or breaches that occur after service completion, including those introduced by automatic updates. Our security measures significantly reduce common risks but do not guarantee absolute protection.
5. Content and Plugins
Existing plugins will not be removed without your consent. If a plugin presents an immediate security hazard, we will disable it and notify you. All work is performed without third-party SaaS services unless explicitly requested by the client at the client’s expense; all optimizations are applied directly to your site.
6. Payment and Refunds
All payments are final once service begins. No refunds will be issued for disputes unless a material breach by KODX.dev is demonstrated. A “material breach” is defined as a failure to perform the core services explicitly outlined in the purchased package description.
7. Limitation of Liability
KODX.dev is not responsible for:
- Pre-existing site issues, plugin conflicts, or theme conflicts.
- Hosting limitations or downtime.
- Security breaches occurring after service completion.
- Issues arising from changes made to the site by the client or third parties after service completion.
- The functionality, updates, or discontinuation of any third-party plugins installed as part of the service.
Service Completion is defined as the point at which the purchased package has been fully implemented and a summary report is delivered to the client via email. Ongoing maintenance, updates, and monitoring are not included unless explicitly stated in a separate maintenance agreement.
8. Prohibited Actions
Fraudulent chargebacks, abuse, or malicious actions will result in immediate termination of service and notification to the relevant payment processor for dispute.
9. Agreement
By completing payment and checking the “I agree to the Terms and Conditions” checkbox, you confirm that you have read, understood, and accepted these terms in full.
